By placing an order or using our shop, you agree to these Terms of Service. Please read them carefully before purchasing.
2. Scope and Application
These Terms of Service apply to all contracts concluded between us and consumers or business customers via our online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).
Deviating, conflicting, or supplementary general terms and conditions of the customer shall not form part of the contract unless we have expressly agreed to their application in writing.
3. Conclusion of Contract
The presentation of products in our shop does not constitute a legally binding offer, but rather an invitation to place an order.
By clicking “Buy Now” or “Complete Order”, you submit a binding offer to purchase the selected products. We will confirm receipt of your order by email immediately after submission.
The purchase contract is concluded when we send you a separate order confirmation or ship the goods. We reserve the right to decline orders at our discretion, in which case any payment already made will be refunded in full.
4. Prices and Payment
All prices shown in our shop are in Euros (€) and include applicable VAT. Shipping costs are shown separately and are added to the product price at checkout.
We accept the following payment methods:
• Credit card (Visa, Mastercard)
• PayPal
• Shopify Payments
Payment is due immediately upon conclusion of the contract. We reserve the right to exclude certain payment methods for individual orders.
5. Delivery and Shipping
We ship to the following countries: [e.g. Germany, Austria, Switzerland, and EU member states].
Estimated delivery times are stated on the respective product pages. These are non-binding estimates. Unless otherwise agreed, delivery takes place within [e.g. 3–5 business days] of receipt of payment.
If a product is temporarily out of stock, we will notify you immediately and provide an estimated restocking date. You may cancel your order at any time before shipment without any charges.
Risk of accidental loss or damage to the goods passes to you upon delivery. For business customers, risk passes upon handover to the shipping carrier.
6. Right of Withdrawal (EU Consumers)
If you are a consumer resident in the EU, you have the right to withdraw from this contract within 14 days of receiving the goods, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and § 312g BGB.
To exercise your right of withdrawal, notify us in writing (email or post) within the 14-day period. You must then return the goods in their original, unused condition at your own expense within a further 14 days.
Upon receipt and inspection of the returned goods, we will refund the purchase price to your original payment method within 14 days.
The right of withdrawal does not apply to:
• Custom-made or personalised products
• Perishable goods
• Sealed hygiene products that have been opened after delivery
• Digital content that has been accessed or downloaded
Please also refer to our separate Return & Refund Policy for further details.
7. Statutory Warranty Rights
Your statutory warranty rights apply in full. If goods are defective or do not conform to the contract, you are entitled to remedies under applicable EU and German consumer law, including repair, replacement, price reduction, or rescission of the contract.
The statutory limitation period for warranty claims is two years from delivery of the goods.
Please contact us within 7 days of delivery if you receive a damaged, defective, or incorrect item. We will work promptly to resolve the issue.
8. Limitation of Liability
We are fully liable for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.
For slight negligence, we are only liable in the event of a breach of a material contractual obligation (cardinal obligation), and only for foreseeable, contract-typical damage.
Liability for indirect damage, loss of profit, or consequential loss is excluded to the extent permitted by law.
The above limitations do not affect liability under the German Product Liability Act (Produkthaftungsgesetz).
9. Intellectual Property
All content on our shop — including text, images, graphics, logos, and product descriptions — is the property of [Your Shop Name] or its licensors and is protected by copyright law.
You may not reproduce, distribute, or use any content from our shop without our prior written consent.
10. Customer Accounts
You may optionally create a customer account to manage your orders and saved addresses. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Please notify us immediately if you suspect any unauthorised use of your account. We reserve the right to suspend or delete accounts that are used in violation of these Terms.
11. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the Federal Republic of Germany. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
If you are a consumer, you also benefit from any mandatory consumer protection provisions of the country in which you reside.
For disputes with consumers, the place of jurisdiction is the consumer’s place of residence. For disputes with business customers, the exclusive place of jurisdiction is [Your City], Germany.
12. Online Dispute Resolution (ODR)
The European Commission provides an online dispute resolution platform for consumers, accessible at: https://ec.europa.eu/consumers/odr
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not voluntarily participate. However, we are always happy to resolve any issues directly — please contact us first.
13. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
14. Changes to These Terms
We reserve the right to update these Terms of Service at any time. The version in force at the time of your order applies to your purchase. The current version is always available on our website.
